THE VERVE is the commercial brand operated by Ludovica Campanella THE VERVE. Throughout the website, the terms “THE VERVE”, “we”, “us” and “our” refer to Ludovica Campanella THE VERVE.
These Terms of Service govern your use of the website and purchases made through https://theverve.online.
By using this website or placing an order, you agree to these Terms of Service together with our Privacy Policy, Shipping Policy and Refund and Returns Policy.
Nothing in these Terms limits or excludes any mandatory rights granted to consumers under applicable European Union or national consumer law.
2. USE OF THE WEBSITE
You may use this website only for lawful purposes.
You may not use the website or its content in a way that infringes intellectual property rights, violates applicable law, interferes with the operation or security of the website, or attempts to obtain unauthorised access to any part of the website.
3. PRODUCTS
THE VERVE offers garments produced in limited quantities.
We make reasonable efforts to describe and display each product as accurately as possible, including its materials, colours, measurements and characteristics.
Colours may appear slightly different depending on your screen, device and display settings.
Because our products are produced in limited quantities, availability may change and a product may become unavailable.
4. PRICES
Prices are displayed in the currency applicable to the market selected by the customer.
Before an order is submitted, the checkout displays the total price payable, including any applicable taxes and delivery charges.
We may change our prices at any time. A price change will not affect an order for which a contract has already been concluded.
Where a price reduction is announced, the previous price or lowest price applied during the relevant preceding period will be displayed where required by applicable law.
5. ORDERS
Before submitting an order, you can review the selected products, quantities, delivery information and total price and correct any errors.
By selecting the final payment or order-confirmation button at checkout, you submit an order involving an obligation to pay.
After the order is submitted, you will receive an electronic order confirmation containing the details of your purchase. The sales contract is concluded when we send this order confirmation, subject to successful payment authorisation.
We may refuse or cancel an order where we are unable to perform the contract for a legitimate reason, including:
- an item becoming unavailable because of an inventory error;
- unsuccessful or unauthorised payment;
- suspected fraud or misuse;
- incorrect pricing caused by an obvious technical error;
- an incomplete or undeliverable address;
- legal or delivery restrictions preventing completion of the order.
If we cancel an order for which payment has already been collected, the full amount paid will be refunded using the original payment method without undue delay.
6. PAYMENT
Payment must be made using one of the payment methods available at checkout.
You agree to provide accurate and complete billing and payment information.
Payments may be processed by third-party payment service providers subject to their own terms and security procedures.
7. SHIPPING & DELIVERY
Orders are prepared and dispatched from Gdańsk, Poland.
THE VERVE currently delivers online orders only within Poland and Italy. Free standard shipping is provided for orders delivered to either country.
Estimated processing and delivery times, tracking information and procedures for delayed, lost or damaged parcels are described in our Shipping Policy.
Delivery times are estimates and may be affected by circumstances outside our reasonable control. Nothing in this section limits the seller’s obligations or the customer’s mandatory consumer rights.
8. RIGHT OF WITHDRAWAL AND RETURNS
Consumers purchasing online may have a statutory right to withdraw from the purchase within 14 days of receiving the goods, subject to applicable legal exceptions.
Information about exercising this right, return conditions, return shipping and refunds is provided in our Return & Refund Policy.
Nothing in these Terms restricts statutory rights relating to defective or non-conforming goods.
9. LEGAL GUARANTEE AND PRODUCT CONFORMITY
Products sold to consumers must conform to the sales contract and are covered by the mandatory legal guarantee provided by applicable European Union and national consumer law.
For consumers, the seller is responsible for a lack of conformity revealed within two years from delivery, without prejudice to any more favourable mandatory rights applicable in the consumer’s country of habitual residence.
If a product is defective, does not correspond to its description or otherwise does not conform to the contract, the consumer may request repair or replacement. Where the statutory conditions are met, the consumer may also be entitled to a price reduction or to terminate the contract and receive a refund.
Complaints concerning non-conforming goods are handled free of charge. We will respond to a consumer complaint within 14 days of receiving it, as required by applicable Polish consumer law.
The legal guarantee of conformity is separate from and independent of the 14-day right of withdrawal.
10. INTELLECTUAL PROPERTY
Unless otherwise stated, all content appearing on this website — including THE VERVE name, branding, photographs, graphics, texts, designs and visual materials — belongs to THE VERVE or is used with appropriate permission.
Content may not be copied, reproduced, distributed, commercially exploited or used without prior permission except where permitted by law.
11. THIRD-PARTY SERVICES
Certain features of the website may rely on third-party services, including payment providers, delivery providers and technology platforms.
Their services may be subject to separate terms and privacy policies.
Nothing in this section limits any rights you may have against THE VERVE under mandatory consumer law.

The processing of personal data through this website is governed by our Privacy Policy.
13. LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
In particular, nothing in these Terms limits your mandatory rights as a consumer or our responsibility for defective or non-conforming goods where such responsibility cannot legally be excluded.
To the extent permitted by law, THE VERVE is not responsible for losses that are indirect or were not reasonably foreseeable when the contract was concluded.
14. GOVERNING LAW
These Terms are governed by the laws of Poland.
If you are a consumer residing in another European Union country, this choice of law does not deprive you of any mandatory consumer protection granted to you by the law that would otherwise apply in your country of habitual residence.
15. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our website, business practices or applicable law.
Changes apply from the date the updated Terms are published and do not alter the terms governing orders already concluded unless required by law.
